Oklahoma retailer must comply with ACA

Posted On Wed, November 28, 2012

Another employer is attempting to fight the provision under the Patient Protection and Affordable Care Act that states that they must cover birth control in their employee health insurance package.

The store owners protested against the ACA, stating that providing birth control for their employees was against their religious beliefs. However, an Oklahoma judge stated that the organization must comply with the law, according to Insurance Journal.

Although churches and other religious institutions have been exempted from this provision of the ACA due to their beliefs, the judge stated that the retail store was not affiliated with religion, and therefore was not exempt.

Courts across the nation have been splitting on whether they allow employers to refuse to provide birth control. However, in this case, the judge upheld the new law, stating that the U.S. had a vested interest in providing inexpensive health insurance rates, including low-cost birth control.
