Louisiana offers home insurance protection in connection with bad drywall

Posted On Fri, November 27, 2009

Many consumers in the country have been affected by Chinese-made drywall, which has been connected to damage to appliances and pipes.

Recently, the Louisiana Commissioner of Insurance announced that homeowners in the state are afforded protection from the negative effects the drywall may have on their home insurance policies. Jim Donelon said that a state statute has been in place for three years that protects homeowners who have left their property while trying to remove the drywall.

Some insurance companies in the state are canceling home insurance policies because of the fact homeowners have left their properties. That or they claim the home has not been maintained in "insurable condition."

Donelon noted that the law protects homeowners from seeing an increase in their premiums, which may come as a result of reporting the drywall problem with their home insurance companies. Reporting the problem is a stipulation to the protection provided by the law..

"I am here to make sure that insurance companies do the right thing and abide by our state's three-year protection rule and all other consumer protection laws on our books," Donelon said.

The U.S. Consumer Product Safety Commission recently announced that there is a connection to the Chinese drywall and damages reported by homeowners. The CPSC's website reports that the organization has received more than 2,000 reports from residents who believe health problems or home damages are connected to the drywall.
