Federal judge rules Obamacare unconstitutionalPosted On Tue, February 1, 2011
President Obama's health insurance legislation suffered a setback yesterday, as a Florida federal judge declared it unconstitutional, pointing to its interference with the Constitution's commerce clause.
In his 78-page decision, Judge Roger Vinton wrote, "I must reluctantly conclude that Congress exceeded the bounds of its authority in passing the act with the individual mandate. That is not to say, of course, that Congress is without power to address the problems and inequities in our health care system .... the principle dispute has been about how Congress chose to exercise that power here."
Vinton went on to say that the entire act must be declared void.
Lawyers for the Obama administration vowed to fight Vinton's ruling, saying in a statement that the law has "well-established legal precedent," and that they will "ultimately prevail on appeal."
Vinton is the fourth federal judge to rule on the constitutionality of the health insurance law. Two sided with the Obama administration and one said it was unconstitutional.
Should it pass legal muster, the new health insurance law would go into effect in 2014.
