Utah Health Insurance Regulations
According to the Utah health insurance laws, any individual who has group or employer health insurance cannot be denied or limited access to coverage under that policy. Individuals looking for individual Utah health insurance coverage can be denied because of health, age, or any other factor. There are some exceptions to this if the individual is not eligible for any other state, group or individual coverage. All Utah health insurance policies are guaranteed renewable which means that any individual is guaranteed the right to renew an existing policy provided he or she has not committed fraud against the insurer and has paid all premiums on time.
Pre-Existing Conditions
Utah health insurance companies can attach elimination riders or pre-existing condition exclusion periods to policies. Elimination riders permanently exclude certain conditions or body parts from coverage for the duration of the policy. A health insurance company can look back six months prior to beginning coverage to see if a health condition was treated or diagnosed. If so, they can exclude the pre-existing condition from coverage for up to 12 months. This is a pre-existing exclusion period. All Utah health insurance companies must offer standardized plans.
Pregnancy
Pregnancy can be considered a pre-existing condition and can be excluded from coverage for a period of time under a pre-existing condition exclusion period. If the parent has an individual Utah health insurance policy that covers dependents, the newborn or adopted child is automatically covered under the parent’s policy for the first 30 days after birth or adoption. Under some circumstances disabled children can remain under the parent’s policy coverage past the age at which most dependents cease to be covered.
Temporary Insurance
For individuals who are between Utah health insurance policies or employer plans, there are some Utah health insurance companies that sell temporary individual health insurance.
Rates
Utah health insurance rates vary depending on health and age but there are limits to premium rates. Rates are based on group health plans instead of individual Utah health insurance.
Alternative Utah Health Insurance Options
For individuals who have difficulty obtaining Utah medical insurance or for those who are considered “uninsurable” by most Utah medical insurance companies, there are some state programs that may help:
- Utah Medicaid is available to qualifying individuals who meet eligibility criteria
- Utah Comprehensive Health Insurance Pool is the state’s high-risk pool that allows “uninsurable” individuals to buy into a state group health insurance plan. Pre-existing condition exclusion periods may apply.
- Utah Children’s Health Insurance Program (UTCHIP) is designed to provide health insurance to children up to 19 years of age whose families do not qualify for Medicaid and who may not be able to afford Utah medical insurance.
