Michigan Health Insurance Regulations

All individual Michigan health insurance is guaranteed renewable which means that an individual is guaranteed the right to renew an existing Michigan health insurance policy provided he or she has not provided false information and has paid all premiums on time. Michigan health insurance law states that all individuals have the right to buy individual Michigan health insurance and Blue Cross Blue Shield of Michigan (BCBSM) is the only Michigan health insurance company that sells individual Michigan medical insurance policies to anyone at any time. All Health Maintenance Organizations (HMOs) in Michigan are required to have an annual 30 day open enrollment period.

Self-Employment Regulations

Self-employment policies can be sold as small-group Michigan health insurance plans even if there are no more employees than the self-employed individual. Although Blue Cross Blue Shield of Michigan and HMOs cannot deny individuals access to Michigan health insurance, other Michigan medial insurance companies can turn down individual applicants based on health. BCBSM is the only organization in Michigan with regulated Michigan health insurance rates. Any other Michigan health insurance organization can charge an individual more for Michigan medical insurance based on health, age or gender.

Pre-Existing Exclusion Regulations

Pre-existing exclusion periods may apply to some Michigan health insurance plans. A pre-existing condition is for which the individual was diagnosed or treated during the six months prior to the beginning of a new Michigan medical insurance policy. The length of time for which the medical condition is not covered (the pre-existing exclusion period) depends on the Michigan health insurance policy. Some Michigan health insurance policies are credited for the pre-existing exclusion period of new polices provided there was no lapse in coverage.

Newborn Insurance Coverage Regulations

Newborns are automatically covered under the parent’s individual Michigan health insurance plan for the first 31 days after birth. Michigan health insurance policies must be adjusted after this period. Disabled or handicapped children can remain as dependents under Michigan health insurance policies even if they are adults.

For Michigan residents who have difficulty affording Michigan health insurance, there are state run programs that may help:

  • Michigan Medicaid is available to any individual who meets the qualifying criteria and eligibility requirements.
  • MIChild is Michigan’s Children’s Health Insurance plan which provides Michigan health insurance to children up to 19 years of age whose families do not qualify for Medicaid but might not otherwise be able to afford Michigan health insurance.
