Georgia Health Insurance Regulations

Georgia requires that all Georgia health insurance companies have a guaranteed renewability provision which guarantees an individual can renew a current Georgia health insurance policy provided the individual has paid all premiums and has not provided false information.

Georgia health insurance companies can require pre-existing condition exclusion periods for individuals who have a medical condition prior to beginning the new plan. New Georgia health insurance plans can restrict coverage for certain conditions for an unlimited amount of time but most limit the exclusion period to a two year maximum. Previous policy coverage may cover new exclusion periods in new Georgia health insurance plans, but even a lapse in coverage of one day can mean and individual has to wait up to a year for the new plan to cover an existing treatment.

Georgia health insurance regulations require that newborns and adopted children be automatically covered under the parent’s individual Georgia health insurance policy for 31 days. This applies even if the Georgia health insurance policy already covers dependents.

Georgia health insurance rates vary depending upon age and health of the individual. Age and health can also be used to deny coverage under a new Georgia health insurance policy. Renewal of an existing Georgia health insurance policy cannot be denied. As age and health changes, however, Georgia health insurance rates can increase for the individual. Keep in mind that group and employer insurance cannot deny coverage to an employee or member of the group for which the Georgia health insurance is issued.

If a Georgia resident ends a policy with a Georgia medical insurance company, that individual may qualify to purchase a temporary Georgia health insurance policy or a conversion policy. These can cover the individual until another Georgia health insurance plan is purchased.
