Colorado Health Insurance Regulations

Colorado health insurance companies must provide coverage under certain regulations and laws. Colorado health insurance companies must have guaranteed renewability provisions in every health care policy. This means that an individual cannot be denied the right to renew an existing policy or Colorado health insurance plan.

Some insurance companies impose restrictions and exclusion periods for pre-existing conditions. Colorado health insurance companies can impose an exclusion period of no more than 12 months after which the policy must cover all pre-existing conditions. In Colorado, a pre-existing condition refers to one for which an individual was diagnosed or treated within the 12 months prior to the beginning of the Colorado health insurance policy or plan. Previous coverage with no lapse in coverage can be used as credit toward the pre-existing condition period of the Colorado health insurance policy.

Colorado health insurance companies may be licensed outside the state. Those licensed inside the state have passed Colorado health insurance regulations. One of these regulations refers to the renewability provision where the individual is guaranteed the ability to renew existing Colorado health insurance.

Individual Colorado health insurance companies can, however, increase rates due to health and age. They can also deny coverage to any high-risk or “uninsurable” applicants. Under Colorado law group and employer heath insurance cannot be denied. Self-employed individuals can, however, purchase small group Colorado health insurance even if there are no employees. An individual must meet certain criteria and cannot purchase a self-employed small group Colorado health insurance policy during the 31-day period following the individual’s birthday.

Alternative Colorado Health Insurance Options

Colorado health insurance and plans may be obtained through state-run organizations if an individual or family meets eligibility requirements. Some of these programs are:

  • Colorado Medicaid and Colorado Indigent Care Program is available to Colorado residents who meet the eligibility criteria.
  • CoverColorado is the Colorado health insurance high-risk pool. This program allows for individuals who might otherwise be uninsurable to purchase Colorado medical insurance.
  • Child Health Plan Plus (CHP+) is the Colorado Children’s Health Insurance Program that provides Colorado health and medical insurance to children up to age 18. This plan also provides Colorado health insurance to pregnant women 19 and over who do not qualify for Medicaid but cannot afford individual Colorado medical insurance.
  • Recipients of the Pension Benefit Guarantee Corporation (PBGC) may be eligible for Health Coverage Tax Credit (HCTC).
