Arkansas Health Insurance Regulations

There are some state laws regulating Arkansas health insurance and the insurance policies and plans. All Arkansas health insurance policies must provide a guaranteed renewability provision to prevent Arkansas health insurance companies from denying a request to renew insurance.

Some Arkansas medical insurance companies have other policies restricting consumers. One of these is a pre-existing condition exclusion provision which, under Arkansas laws, allows Arkansas health insurance companies to temporarily or permanently exclude coverage for any individual with any pre-existing medical condition. By Arkansas law definition, a pre-existing condition is one that has received medical treatment prior to beginning health insurance.

Arkansas laws allow Arkansas health insurance companies to deny coverage or charge more of coverage based on health. Health status of an individual may be taken into account every time that individual renews Arkansas health insurance. This, of course, can result in a significant increase of premiums. There are also Arizona health insurance companies that provide access to temporary insurance if an individual is between plans.

Alternative Arkansas Health Insurance Options

Alternaive Arkansas health insurance plans are available to those who may not qualify for individual health insurance or Akansas medical insurance plans. Some of these options are:

  • Arkansas Medicaid is available to qualifying individuals who meet income criteria.
  • Arkansas Comprehensive Health Insurance Plan (CHIP) is the Arkansas high-risk pool for health insurance. This insurance program is available to those who are otherwise considered “high-risk” or “uninsurable” under most Arkansas health insurance plans. A pre-existing condition may apply.
  • ARKids First is the state Children’s Health Insurance Program that is designed to provide health insurance to children under 19. To qualify for this program, families must not be eligible for Medicaid but cannot afford Arkansas health insurance on their own.

  • Health Coverage Tax Credit (HCTC) for those receiving benefits under the TAA program
  • Pension Benefit Guaranty Corporation (PBGC) recipients may be eligible for HCTC.
