Alabama Health Insurance Regulations

Although federal law protects health insurance standards through the Health Insurance Portability and Accountability Act (HIPAA), states can pass different reforms for the health care in that state. Neither federal nor state laws protect access to individual or group Alabama health insurance under all circumstances.

There are no standards for Alabama health insurance in regards to either policy coverage or price. However, the state requires that all Alabama health insurance cover certain benefits such as post-delivery hospital stays and breast cancer screening. The Alabama Insurance Commissioner does, however, have power over Alabama health insurance rates and costs to ensure that fees, charges, and rates are not unreasonably high or excessive.

Alabaman health insurance companies providing individual health insurance do not have to give credit for prior coverage, unlike group health plans. Also, pregnancy may be considered a pre-existing condition under certain Alabama health insurance policies. Any pre-existing condition may require an exclusion period by the insurer that is not to exceed 24 months.

Alternative Alabama Health Insurance Options

Depending on the financial and medical circumstances of the individual, the following plans may provide some health insurance or medical coverage for the Alabama resident:

  • Alabama Medicaid is available for those that qualify.
  • Alabama Health Insurance Plan (AHIP) is designed to let Alabama residents maximize the features of HIPAA. This means that individuals that might otherwise be considered “uninsurable” are able to purchase Alabama health insurance. Alabama Health Insurance Plan is considered the high-risk health insurance pool for the state of Alabama and all participants must be HIPAA eligible.
  • All Kids is Alabama’s children’s health insurance program and is designed to provide medical insurance to children under the age of 19. Eligible families must meet All Kids guidelines in order for children to be considered for Alabama medical insurance through this program. Such families are usually considered ineligible for Medicaid due to higher income levels.
